FORKED CREEK CATERING – CHINA RENTAL AGREEMENT

1. RENTAL ORDER AND EVENT DATE. The renter is responsible for reviewing the rental date, quantity, selections, fulfillment method, venue information, and order total before checkout. The rental is not reserved until the required agreement is accepted and required payment is successfully received.

2. POSSESSION AND CARE. The renter is responsible for the rented china, glassware, flatware, linens, and related items from the time they are delivered to or picked up by the renter or the renter’s authorized representative until they are returned to or retrieved by Forked Creek Catering. The renter agrees to use reasonable care and to use the rented items only for their intended purpose.

3. COUNT, CONDITION, LOSS, AND BREAKAGE. The renter should promptly report any known shortage or pre-existing damage discovered at pickup or delivery. The renter is responsible for rented items that are lost, missing, destroyed, or damaged beyond ordinary wear while in the renter’s possession or control. Forked Creek Catering may charge reasonable replacement or repair costs, including applicable sourcing or shipping costs, for such items.

4. FOOD REMOVAL AND REQUIRED RINSING. Before the rented items are returned or staged for retrieval, the renter must remove all food, trash, and personal items and rinse all rented dishes, flatware/silverware, and glassware to remove food and beverage residue. The renter is not required to wash or sanitize the items; Forked Creek Catering will wash and sanitize all returned rental items. Items returned with food, beverage residue, or excessive debris that requires additional handling or cleaning may result in an additional reasonable cleaning charge. The renter must separately initial this section as confirmation that these rinsing requirements were reviewed and understood.

5. PICKUP, RETURN, DELIVERY, AND RETRIEVAL. Customer pickup/return orders must be picked up and returned at the times and location arranged with Forked Creek Catering. Delivery/retrieval orders require reasonable and safe access to the venue and rental items at the agreed times. The renter is responsible for providing accurate venue information and an available day-of contact. Additional trips, unreasonable delays, inaccessible items, or late return may result in an additional reasonable charge.

6. CANCELLATION AND REFUNDS. Cancellation, refund, and payment terms are governed by the Forked Creek Catering cancellation/refund policy and the order terms presented to the renter at the time of booking, together with any later written amendment agreed to by Forked Creek Catering.

7. CHANGES TO THE RENTAL. Changes to quantities, selections, date, fulfillment, or other material terms are subject to availability and must be approved by Forked Creek Catering. A change made after this agreement is signed does not alter the original signed record; material changes may require a written amendment or updated agreement.

8. AUTHORIZED CONTACT. The renter authorizes the day-of contact listed with the order to coordinate practical delivery, pickup, staging, and retrieval matters for the rental. This authorization does not permit that person to materially change the financial terms of the rental unless separately authorized.

9. ELECTRONIC RECORDS AND SIGNATURE. By checking the electronic-signature consent box and typing the renter’s full legal name, the renter confirms that the renter has read this agreement, agrees to its terms, consents to conduct this transaction electronically, and intends the typed name to serve as the renter’s electronic signature. The renter agrees that the electronic copy retained with the order may be used as the record of the signed agreement.

10. ENTIRE RENTAL RECORD. This agreement, the WooCommerce order, the selections and details saved with that order, and any written amendment accepted by Forked Creek Catering together form the rental record. If a specific written amendment conflicts with this agreement, the later written amendment controls only to the extent of that conflict.
