These Terms & Conditions apply to purchases, orders, rentals, invoices, and services provided by Forked Creek Catering, LLC (“Forked Creek Catering,” “Forked Creek,” “we,” “us,” or “our”), including orders placed through the Forked Creek Market, china and event-equipment rentals, and full-service catering invoices or proposals paid through our website.
By submitting an order, paying an invoice, signing an agreement, or completing checkout, the customer acknowledges and agrees to these Terms & Conditions together with any service-specific proposal, rental agreement, order details, or payment schedule applicable to the transaction.
These General Terms apply to all Forked Creek Catering orders, rentals, invoices, and services unless a service-specific section below states otherwise.
An order, invoice payment, or proposal payment does not create rights to services beyond those specifically identified in the applicable order, invoice, proposal, or agreement.
Forked Creek Catering reserves the right to decline or cancel an order when necessary due to availability, operational limitations, incorrect pricing, service-area limitations, safety concerns, or circumstances beyond our reasonable control. If Forked Creek Catering cancels an order and no service has been provided, amounts eligible for refund will be returned according to the applicable service terms.
Prices are those shown in the customer’s order, invoice, proposal, or agreement at the time of purchase.
Applicable taxes, delivery charges, service charges, rental charges, staffing charges, processing charges, or other disclosed fees may be added where applicable.
Payment requirements vary depending on the type of order and the payment option selected.
The amount required at checkout or invoice payment will be displayed before payment is submitted. If a remaining balance exists, the customer is responsible for making all required payments according to the payment schedule stated in the applicable order, invoice, proposal, catering agreement, or payment-plan terms.
Failure to make required payments by the applicable deadline may result in cancellation, suspension of services, or other remedies permitted under the applicable agreement.
Electronic payments are processed through third-party payment providers.
Forked Creek Catering does not store complete payment-card information.
Customers are responsible for ensuring that payment information provided is accurate and authorized for use.
Certain eligible purchases may offer third-party financing or installment services such as Affirm or Klarna.
Approval, payment schedules, interest or fees, credit decisions, and other financing terms are determined by the applicable third-party provider and are governed by the customer’s agreement with that provider.
Use of Affirm, Klarna, or another third-party financing provider does not alter Forked Creek Catering’s cancellation, refund, rescheduling, service, or rental policies.
Any refund approved by Forked Creek Catering will be processed through the applicable payment provider in accordance with that provider’s procedures.
When a Forked Creek Catering payment plan is offered and selected, the customer agrees to the payment schedule disclosed at checkout, on the invoice, or in the applicable agreement.
The amount due at the time of purchase and each remaining payment due date will be disclosed before the customer accepts the payment plan.
Additional payment-plan terms, including missed-payment provisions, may apply and will be disclosed when the payment-plan feature is available.
This section applies specifically to food and related products ordered through the Forked Creek Market.
Market orders are accepted only for dates shown as available through Forked Creek Catering’s ordering system.
A selected date is not considered reserved until the applicable order and required payment have been successfully completed.
Market availability is limited by Forked Creek Catering’s daily production and service capacity.
Market orders must satisfy the advance-order requirements displayed at the time of ordering.
Orders placed outside the permitted booking window may not be accepted.
Certain Market items are subject to minimum quantities, maximum quantities, combined-order limits, guest-count requirements, or other product-specific restrictions.
These limits are displayed on the applicable product pages or enforced during cart and checkout.
Customers may not intentionally divide an order into multiple transactions to bypass stated order limits or capacity restrictions.
Pickup and delivery availability varies by order and location.
Customers are responsible for providing accurate delivery addresses, contact information, event/service dates, and requested service information.
Delivery windows represent an anticipated service period and may not constitute a guaranteed exact arrival time unless specifically confirmed in writing.
Once food has been delivered or picked up, the customer assumes responsibility for proper holding, storage, reheating, service, and food-safety practices.
Forked Creek Catering is not responsible for food that has been improperly stored, held, transported, reheated, or served after transfer to the customer.
Forked Creek Catering will make reasonable efforts to accommodate disclosed dietary requests when agreed upon in advance.
However, food is prepared in kitchens where common allergens may be present, including but not limited to milk, eggs, wheat, soy, peanuts, tree nuts, fish, and shellfish.
Forked Creek Catering cannot guarantee that any menu item is completely free from allergens or cross-contact.
Customers are responsible for informing Forked Creek Catering of known allergy concerns before ordering and for communicating relevant information to their guests.
All cancellation requests must be submitted in writing.
Orders cancelled more than 30 calendar days before the scheduled service date are eligible for a refund of 50% of the amount paid.
If an order is cancelled 30 calendar days or fewer before the scheduled service date, the customer may choose one of the following:
Refund Option:
Receive a refund equal to 25% of the amount paid.
Account Credit Option:
Instead of a cash refund, the customer may receive a future Forked Creek Catering account credit equal to the amount paid, less a $150 cancellation charge.

Date-change requests are subject to availability.
Requests made more than 30 calendar days before the original service date may be accommodated without a rescheduling fee if Forked Creek Catering is available.
Requests made 30 calendar days or fewer before the original service date are subject to a $150 rescheduling fee.
If Forked Creek Catering cannot accommodate the requested new date and the customer does not retain the original date, the applicable cancellation terms above will apply.
This section applies when an order includes Forked Creek Catering china, flatware, glassware, linens, or other rental items.
Rental items are reserved only for the date and quantities shown on the confirmed order.
Availability is limited, and a rental date is not reserved until the applicable reservation requirements and payment obligations have been satisfied.
The customer is responsible for rental items from the time they are delivered to or picked up by the customer until they are returned to Forked Creek Catering or collected by Forked Creek Catering.
Rental items must be handled with reasonable care.
Unless otherwise stated in the rental agreement, used china and serviceware must be appropriately scraped and rinsed according to the instructions provided with the rental.
Items should not be left soaking.
The customer is responsible for missing, broken, damaged, or excessively soiled rental items beyond ordinary use.
Replacement or additional cleaning charges may be assessed based on the applicable replacement or cleaning cost.
Rental items must be accessible and ready for pickup at the agreed time when Forked Creek Catering is collecting them.
When customer pickup/return is selected, the customer is responsible for returning the rental items according to the agreed schedule.
Certain rentals may require an additional electronic rental agreement or acknowledgment.
Where a rental agreement contains terms more specific to the rental transaction, those terms supplement these Master Terms.
This section applies to full-service catering events booked through a Forked Creek Catering proposal or catering agreement, including invoices paid through WooCommerce.
The applicable proposal and catering agreement define the specific menu, services, staffing, rentals, event date, guest count, pricing, and other event-specific terms.
Payment of a WooCommerce invoice does not replace the catering agreement.
The catering agreement and these Master Terms are intended to operate together.
A catering event is considered booked only when the booking requirements stated in the applicable catering agreement have been satisfied.
Unless otherwise stated in writing, this includes the required signed agreement and applicable retainer/payment.
The customer’s specific proposal or catering agreement controls the required retainer, installment schedule, and final-payment deadline.
Forked Creek Catering’s standard catering arrangements may include a non-refundable retainer and scheduled balance payments.
When a third-party financing provider such as Affirm or Klarna is used to pay a catering invoice, the customer’s financing arrangement with that provider does not alter the customer’s obligations under the Forked Creek Catering agreement.
The final guaranteed guest count is due according to the deadline specified in the catering agreement.
After the final count deadline, decreases may be restricted and increases are subject to availability, staffing, equipment, and product availability.
Menu, service, venue, timeline, guest-count, rental, and staffing changes are subject to availability and may result in price adjustments.
Changes are not binding until accepted by Forked Creek Catering.
Full-service catering cancellations are governed by the cancellation provisions contained in the customer’s catering agreement.
Where the catering agreement contains a service-specific cancellation schedule, that schedule controls over the Market cancellation provisions in these Master Terms.
Approved refunds will generally be returned to the original payment method whenever reasonably possible.
Refund processing times depend on the customer’s bank, card issuer, or payment provider.
Payment-processing fees that are not returned to Forked Creek Catering may be deducted from an approved refund when permitted by applicable law and the applicable service agreement.
A refund issued through Affirm, Klarna, or another third-party payment provider may also be subject to that provider’s procedures and processing timeline.
Forked Creek Catering will not be responsible for failure or delay in performance caused by circumstances beyond its reasonable control, including severe weather, natural disasters, government actions, utility interruptions, transportation disruptions, venue closures, public emergencies, or other extraordinary circumstances.
When such an event occurs, Forked Creek Catering will make reasonable efforts to communicate with the customer and determine available options.
Forked Creek Catering will provide only the food, rentals, staffing, delivery, setup, service, or other items specifically included in the applicable order, invoice, proposal, or agreement.
Services not listed should not be assumed to be included.
The customer is responsible for providing accurate:
Forked Creek Catering is not responsible for delays, additional charges, or inability to perform services resulting from materially incorrect or incomplete information supplied by the customer.
Forked Creek Catering does not provide bartending or alcohol services.
Electronic acceptance, including clicking an agreement checkbox, typing a name, signing electronically, submitting payment, or completing checkout, may constitute the customer’s agreement to the applicable terms.
Records of electronic acceptance may be retained with the applicable order or transaction.
Because Forked Creek Catering offers different types of services, certain transactions may include additional service-specific documents.
If provisions conflict, the following order will generally apply:
This provision does not override any right that cannot legally be waived.
Questions regarding an order, cancellation, refund, rental, invoice, or these Terms & Conditions should be submitted to Forked Creek Catering using the contact information provided on the Forked Creek Catering website.
